1. Educational & Self-Development Disclaimer

The Service provides educational courses, interactive communication exercises, and self-awareness frameworks, including "The Architecture of You". All course materials, lessons, worksheets, and resources are designed strictly for educational, informational, and personal self-development purposes.

To access our interactive course platform, practice exercises, and dashboard, you must register for an account.

Eligibility: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account and purchase subscriptions.

Account Information & Verification: You agree to provide true, accurate, current, and complete information during registration and to maintain and promptly update this information. You must verify your email address via the verification link sent to your inbox to activate your account.

Password & Security: You are responsible for maintaining the confidentiality of your account credentials (including your password) and for restricting unauthorized access to your devices. You are fully responsible for all activities that occur under your account.

Social Single Sign-On: You may register and sign in using supported third-party single sign-on services (such as Google). By using social sign-in, you authorize us to receive authenticated account credentials and profile details (such as your verified email address and name) in accordance with our Privacy Policy.

Individual License: Each subscription is licensed for single-user, individual use only. You may not share, transfer, or resell your account credentials to any third party.

Security Verification: To protect the platform against fraud, automated brute-force attacks, and abusive bot activity, automated security and challenge verification checks may be performed during account registration and login.

Course Guidance & Memento Notifications: When you create an account for our practice course platform, you agree to receive automated educational guidance and reminder emails ("memento notifications"). These notifications are designed to help you navigate the platform, maintain consistent study momentum, and offer guidance if you become inactive or stuck on a lesson. These messages are educational and instructional in nature—not promotional advertisements—and you may unsubscribe from them at any time via the unsubscribe link in any notification email or by contacting support.

Content Newsletters: If you subscribe to our newsletter or join our mailing list, we collect your email address to deliver periodic updates, articles, insights, and news regarding new Savvy Simian content and learning tools. You may unsubscribe from our newsletter at any time via the one-click unsubscribe link provided in every newsletter email.

3. Subscriptions, Pricing & Free Trial

Full access to our course modules, interactive scenarios, and Field Guide is provided on a recurring subscription basis.

Subscription Plans & Pricing: Subscription plan details, features, and pricing are set accordingly to the Subscriptions plans section on our course page at /practice (https://savvysimian.com/practice) and presented at checkout.

Free Trial: Eligible first-time subscribers may be offered a free trial. The free trial begins upon successful account registration and checkout verification. Unless you cancel your subscription prior to the end of the free trial period, your subscription will automatically convert into a paid, recurring subscription at the plan rate selected at signup, and your payment method will be charged accordingly.

Automatic Renewal: Subscriptions automatically renew at the beginning of each billing cycle (e.g., monthly or annually) at the then-current plan rate until you cancel.

Price Modifications: We reserve the right to modify subscription pricing. Any price changes will be communicated in advance and will take effect on your next renewal billing cycle. Your continued use after the effective date constitutes agreement to the updated price.

4. Merchant of Record & Payment Processing

Merchant of Record Disclosure: All financial transactions, orders, billing, and subscription payments for Savvy Simian are processed and fulfilled by our authorized Merchant of Record, Creem (Creem, Inc. / Creem Technologies).

When you purchase a course subscription, you enter into a transaction directly with Creem as the Merchant of Record. Creem is responsible for securely handling your payment information in compliance with PCI-DSS standards, calculating and remitting applicable sales tax or Value Added Tax (VAT) to competent authorities, and issuing your order confirmations, receipts, and invoices.

Savvy Simian does not collect, receive, or store your full credit card numbers or sensitive payment account details on our servers.

5. Subscription Cancellation & Management

Self-Serve Cancellation: You may cancel your recurring subscription at any time directly through your account dashboard by opening the self-serve Customer Portal (accessible at /practice/subscription under Billing Settings).

Effective Date of Cancellation: Cancellation halts future recurring charges. Your access to paid course modules and materials will remain active until the conclusion of your current paid billing cycle or free trial period. After this date, your access will transition to inactive status and no further charges will occur.

No Prorated Credits: Except as required by applicable mandatory consumer protection laws, subscription payments are non-refundable and we do not provide prorated credits or refunds for partial billing periods.

6. Refund Policy & Customer Support

We stand behind the quality of our educational course. Our free trial provides ample opportunity to experience the curriculum and platform risk-free before any payment is collected.

Statutory & Consumer Rights: If you encounter technical issues preventing course access, or if you believe you are entitled to a refund under statutory consumer rights (such as statutory 14-day withdrawal rights for consumers residing in the European Union or United Kingdom), please reach out to customer support at contact@savvysimian.com.

Customer Support Response: We are dedicated to providing responsive, high-quality service. Our support team aims to review and respond to all customer inquiries and refund requests within 3 business days.

7. Intellectual Property & Limited License

Proprietary Ownership: All content within the Service—including curriculum structure, lesson texts, audio recordings, diagnostic frameworks, interactive practice scenarios, graphics, illustrations, trademarks, and Field Guide documents—is the exclusive proprietary intellectual property of Savvy Simian and its licensors.

Grant of License: Subject to these Terms and an active account in good standing, Savvy Simian grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the course materials solely for your individual, non-commercial self-study.

Prohibited Uses: You may not copy, record, capture, reproduce, republish, distribute, broadcast, scrape, download (except where expressly designated), sell, lease, sub-license, or create derivative works from any course content or software without our prior written authorization.

8. Prohibited Conduct & Acceptable Use

You agree that you will not:

Use the Service for any unlawful, fraudulent, or harmful purpose;

Probe, scan, or test the vulnerability of our systems or networks, or breach any security or authentication measures;

Use automated systems, bots, spiders, or scrapers to extract data, content, or credentials from the Service;

Interfere with or disrupt the normal operation of the Service, servers, or connected networks;

Circumvent access controls, paywalls, or trial eligibility mechanisms;

Attempt to decompile, reverse engineer, or disassemble any part of the platform or course software.

9. Analytics & Tracking Technologies

We utilize third-party analytics and advertising technologies—including Google Analytics and Meta (Facebook) tracking tools—to evaluate platform traffic, optimize course delivery, and measure campaign effectiveness. Our use of these technologies is governed by our Privacy Policy and Cookies Policy, and non-essential tracking is deployed strictly in accordance with your cookie consent choices.

10. Termination & Account Suspension

We reserve the right, at our sole discretion, to suspend or terminate your account and revoke your access to the Service without prior notice if we determine that you have breached these Terms, engaged in fraudulent or abusive conduct, or violated our intellectual property rights. Upon termination, your right to use the Service ceases immediately.

11. Disclaimer of Warranties

THE SERVICE AND ALL MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAVVY SIMIAN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Savvy Simian, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your use or misuse of the Service.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the applicable operating jurisdiction of Savvy Simian, without regard to its conflict of law principles. Any legal disputes arising under these Terms shall be resolved in the competent courts located within said jurisdiction.

15. Modifications to Terms

We reserve the right to revise or update these Terms at any time. When updates occur, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide notice through our Service or via email prior to the changes taking effect. Your continued use of the Service following any changes constitutes your binding acceptance of the revised Terms.
